Preamble:

The website of the CASHMERE HOUSE boutique is an electronic site that can be accessed via the Internet at www.cashmere-house.com. It is open to any user on this network. It is edited by the CASHMERE OF THE WORLD company, marketing the CASHMERE HOUSE, Ltd. Brand, a company with capital of € 7,622.45, with headquarters located at 9 Rue Aguesseau, 75008, Paris, listed in the Registry of Commerce and Business under the number B408 770 290. Among other purposes, it serves to allow CASHMERE HOUSE to offer its products for sale to web customers who browse on its site.

Prior to an order, the Buyer declares that he/she is by law fully authorized to be able to agree to the present general sales conditions.

Any order of a Product offered on the Site assumes consultation and express agreement with the present general conditions of sale without however such acceptance being valid only on the condition of a handwritten signature provided by the User. In compliance with the provisions of the articles 1316 to 1316-4 of the Civil Code, supplemented by order No. 2001-2782 from March 30, 2001, taken for application of article 1316-4 of the civil code in relation to electronic signatures, users are reminded that the validation of the order form such as is explained in article 3.3 hereafter, constitutes an electronic signature which has among the Parties the same value as a handwritten signature.

1. Purpose

The following general conditions of sale have as a purpose, on the one hand, to inform any possible consumer of the conditions and methods with which the seller proceeds with the sale and delivery of the products ordered, and on the other hand, to define the rights and obligations of the parties in the instance of the sale of products by the seller to the consumer. They apply without restriction or reserve to all of the sales of products offered on the Internet site of the CASHMERE HOUSE boutique.

CASHMERE HOUSE reserves the right to modify the present general conditions of sale at any time. In this case, the conditions applicable will be those in force on the date the buyer places the order.

2. Products and prices

2.1 Products

In compliance with article L. 111-1 of the consumer’s code, on the CASHMERE HOUSE boutique website, the User may inform him/herself on the essential characteristics of the product(s) he/she wishes to purchase before placing an order.

The buyer selects one or more products among the various categories offered on the CASHMERE HOUSE boutique website.

The offers made by CASHMERE HOUSE are valid while supplies last. CASHMERE HOUSE reserves the right to modify the range of products available, in particular according to limitations imposed by suppliers.

Photographs, graphics, and descriptions of products offered for sale are only for reference and do not equate to a commitment by the seller.

In case of a product modification, the graphic representation of the product does not represent a commitment on the part of the vendor nor does it affect the validity of the sale.

2.2 Price

The sales prices of products online on the Internet site of the CASHMERE HOUSE boutique are indicated in euros, and are those in force at the time the order form of the Buyer is recorded.

They do not include shipping costs and handling the order, which are billed in addition to the price of the products purchased depending on the amount of the order. Shipping charges are indicated before the Buyer’s order is registered.

Prices include value added tax (VAT) applicable on the day of the order. Any applicable rate change is automatically reflected in the prices of products sold by CASHMERE HOUSE on its website.

The sales price of products can be modified by CASHMERE HOUSE at any time. The Buyer will be notified of this change before any purchase is made.

3. Recording and validating the order

3.1 Navigation within the website

The user can inform him/herself of the various products offered for sale by CASHMERE HOUSE on its website. Visitors may navigate freely through the various pages of the site without being obligated to make an order. The user is responsible for any telecommunications charges for access to the Internet when using the site.

3.2 Ordering

Any order presumes agreement without restriction or reservation to the present general conditions of sale. If the user wishes to place an order, he/she will choose the various products of interest and will provide evidence of said interest by clicking on the “Add to Basket” box. Starting from the moment in which the Buyer records his/her order by clicking on the “Validate my Order” button, he/she is considered to have accepted with full knowledge and without reservation the present general conditions of sale, prices, volumes and quantities of the products ordered.

At any moment, the Buyer may:

Obtain a summary of the Products he/shehas selected, or modify his/her order, by clicking on “My Basket” which is accessible on each page, continue selecting products, end his/her selection of products, and order them by clicking on “confirm my order.”

To order Products that have been chosen by this procedure, the Buyer will click on “Confirm my Order.” The Buyer will then need to identify him/herself, either by entering his/her email address as well as his/her password, if he/she is already registered as a Member, or by correctly filling out the form provided, on which he/she will provide information required for identification purposes: including last name, first name, postal address.

The Buyer is informed and accepts that the entry of any identifying information equates to proof of his/her identity and is evidence of his/her consent. 3.3 Final validation of the order

He/she will choose the means of payment to be used to pay for the order, provided that the buyer possesses the means of payment as defined in article 4 below. He/she will click on the button that corresponds to the means of payment chosen.

The sale will not be considered final until after the Buyer has been sent confirmation of the order from CASHMERE HOUSE and the full payment of the price has been deposited by CASHMERE HOUSE.

CASHMERE HOUSE recommends that the buyer save this information in a paper or computer file.

Any order that is fraudulent or appears to be fraudulent will be considered nul and void by CASHMERE HOUSE.

4. Payment

Payment should be made by the buyer upon placing the order. Amounts paid can not be considered at any time to be a deposit or down payment.

All orders are payable in euros. The buyer guarantees CASHMERE HOUSE that he/she possesses any necessary authorizations to use the method of payment chosen when the order form is submitted.

CASHMERE HOUSE reserves the right to suspend or cancel any order and/or delivery, regardless of type or degree of completion in case of non-payment or any sum that could be due by the Buyer, in case of payment incident or in case of existing litigation with the Buyer.

Penalties of an amount equal to the legal interest rate marked up by five points are fully applicable to the amounts not paid once a period of ten days has passed following the date of invoicing or notification of rejection of a bank payment or any other means of payment. The delivery of any new order may be suspended in case of delay of payment of a previous order, and this, notwithstanding the present provisions.

For all payments, CASHMERE HOUSE reserves the right to request a photocopy of the identity card of the buyer, and if applicable the identity card of the holder of the means of payment used by the buyer. For amounts greater than 400, taxes included, CASHMERE HOUSE reserves the right to request an official certified photocopy of an identity card.

As part of the fight against Internet fraud, the information regarding any order may be transmitted to any third party for the purposes of verification.

To settle payment for an order, the buyer may use the following forms of payment: bank card (Carte Bleue, Visa, or Master Card). Payments may be made by bank card. They will be processed through the use of the Elysnet secured system. It uses the SSL protocol (Secure Socket Layer) which ensures that the information transmitted is encrypted by software, so that no third party can have access during the course of transmission across the network.

In case of payment by bank card, the buyer’s account will be debited on the day of the order.

5. Choice of products

After informing him/herself of the products marketed by CASHMERE HOUSE and their characteristics, the Buyer is solely responsible for the selection of the product or products that will be the subject of his/her order, based on his/her previously determined needs, before the placement of any order. What’s more, because he/she is the only one to know the products he/she possess and uses, the Buyer is the sole judge of the compatibility of the products ordered with those he/she uses.

If he/she does not deem him/herself sufficiently competent, it is the exclusive responsibility of the Buyer to seek the assistance of advice.

6. Delivery and receipt

6.1 General rules

The products will delivered at the address indicated by the buyer on the order form, which should be a destination consistent with the geographical location previously agreed upon.

By default, bills are sent to the shipping address indicated by the Client when registering.

In the absence of respect for the procedures described below, no claim by the Buyer will be accepted.

6.2 Specific terms of the Postal Service’s Colissimo System

The Buyer’s deliveries are delivered at his/her home address by postal delivery. In case of absence, the Buyer or recipient of the product ordered will receive a notice of attempt to deliver which allows him/her to pick up the products ordered at the nearest post office for a period of fifteen days. The Buyer is expected to verify in the presence of the postal or delivery agent the state of the packaging of the merchandize and its contents upon delivery.

Should the Buyer have any doubt whatsoever of any kind on the state or contents of his/her package, he/she is required to apply Colissimo procedures (specifically, identifying damages due, any claims or reservations) and to refuse the merchandize by immediately issuing a statement of anomaly with the Postal agent (remark 170) or at the nearest post office within 48 hours of package delivery. Finally, the Buyer should notify CASHMERE HOUSE within 48 hours of these incidents by sending a message to contact@cashmere-house.com, specifying the order number.

6.3 Time Necessary for Delivery

The following are the delivery time frames applicable following validation of your order:

Colissimo by the Postal Service: for France, 3 to 5 working days, for other countries, delivered in 5 to 7 working days

Any order confirmed before 3pm from Monday to Friday (except for holidays) is generally processed the same day depending on available supplies. And any order confirmed from noon on Friday to Sunday evening will be processed generally on the following Monday (except for holidays). These delivery time frames are provided for reference only.

No possible delay beyond these time frames can give rise to damages or interests, deduction or cancellation of the order by the Buyer.

In any event, and as set out in the provisions of article L. 121-20-3 of the consumer code, products ordered will be delivered witihin a maximum of 30 days starting from the day following the day the Buyer submitted his/her order, subject to complete payment of the price.

In the absence of delivery when this time frame expires, the Buyer will have the option of cancelling his/her order. Amounts paid by the Buyer will be reimbursed to him/her right away, to the exclusion of any other indemnification.

In the case of delivery delay with respect to the date originally set, the Buyer should notify CASHMERE HOUSE in writing (letter, email), in order to improve the quality of service offered to the buyer and to enable CASHMERE HOUSE to proceed with an investigation involving the shipping agent. An investigation with the shipping agent may last up to 21 working days. If during this time, the products are located, they will be immediately shipped to the delivery address listed on the order form.

However, if the product ordered has not been found during the 21 day period of investigation, CASHMERE HOUSE will then at its own expense send out a new shipment of the products ordered by the Buyer.

6.4 Unavailability of the Products

Products are offered while supplies last. In case one of its products is unavailable, the Buyer will be informed as quickly as possible. This information may be communicated as much as is possible in the following manner: when the order is made, directly online; following confirmation of the order, prior to delivery, via email message.

CASHMERE HOUSE will take the necessary steps with the bank to deduct the price(s) of the article(s) unavailable from the amount deducted from the Buyer’s bank account if the payment has been made by bank card.

In any of the aforementioned instances, the Buyer will have the possibility of cancelling his/her order, requesting by email message sent to contact@cashmere-house.com, either the reimbursement of the amounts paid within thirty (30) days at the latest after they were deducted, or the exchange of the unavailable product(s). In the case of a product exchange, the delivery costs will be borne by the consumer.

7. Right of withdrawal

In compliance with article L. 121-20 of the consumer code, the Buyer has a period of seven clear days from the day of receipt in which to return for reimbursement the products ordered at his/her expense.

The products must be returned to CASHMERE HOUSE in perfect resale condition in their original state (packaging, accessories, sales slip), duly sealed, with the return number obtained according to the procedure described in article 8 below. When a buyer returns products, any risk linked to the return of the product is borne by the buyer.

If the aforementioned conditions are met, CASHMERE HOUSE will exchange the product or reimburse the buyer for the amount corresponding to the products acquired by him/her within thirty days.

8. Return of products by mail

To return an article, the buyer should first contact the CASHMERE HOUSE company to obtain a return number. He/she can do this by email at contact@cashmere-house.com, providing the order number and the reference of the article(s) at issue, as listed in the delivery slip.

Once the return number has been obtained, the Buyer will send the package to the following address: Cashmere of the world, 9 rue Aguesseau, 75008 Paris.

CASHMERE HOUSE will not accept any return package if it is not accompanied by a return number. CASHMERE HOUSE will also not accept packages addressed with postage due.

In the absence of respect for the procedures explained above and the time frames indicated above, the buyer will not be able to submit any claim based on non-compliance or apparent damage to the products delivered, as the products will then be understood to be compliant and exempt from any apparent damage.

9. Claim of ownership

CASHMERE HOUSE retains full and complete ownership of the products sold until complete deposit of the purchase price in principal including any applicable fees and taxes.

10. Liability

CASHMERE HOUSE can not be held liable for the non-completion of the contract due to supply disruption or product unavailability due to force majeure, disturbance, or total or partial strike, in particular of the postal service and means of transport and/or communications. CASHMERE HOUSE assumes no liability for any loss of data or files. It is the responsibility of the Buyer to see to the necessary backup of information.

The CASHMERE HOUSE website also stores information provided by third parties and links toward other internet sites. CASHMERE HOUSE can in no way be held liable for damages resulting from the use, access to or inability to use such third-party information, or such external internet sites.

11. Partial non-validity

If one or more stipulations of the present general conditions of sale are held to be non-valid or declared as such in the application of a law or regulation, or following a definition decision by competent legal jurisdiction, the other stipulations will maintain all of their force and applicability.

12. Non-relinquishment

The fact that one of the parties does not make a claim to the other party regarding a breach for any of the obligations indicated within the present general sales conditions can not be interpreted in future as a relinquishment of the obligation at issue.

13. “Computing and Personal Freedoms”

13.1 Identifying information:

Providing identifying information as part of mail-order sales is mandatory as this information is necessary for processing and delivery of orders as well as for the billing process. This information is strictly confidential. Non-provision implies automatic voiding of the order.

In compliance with the law no. 78-17 dated January 6, 1978 regarding computing, files and personal freedoms, the processing of identifying information collected on the website has been the subject of a declaration made with the National Commission for Computing and Personal Freedoms. The User is endowed with the right to access, modify, correct, or delete data kept about him/her. To exercise this right, the User should send a letter to Cashmere of the world at 9, rue d’Aguesseau, 75008 Paris.

13.2 Cookies

CASHMERE HOUSE reserves the right to place cookies in the computers of visitors to its website. A cookie does not allow us to identify you. It is a computer file, stored on the hard drive of the user’s computer. Its goal is to signal a previous visit of the user to the website. Cookies are only used by CASHMERE HOUSE with the goal of providing personalized service to the user.

14. Intellectual Property

Every element of the CASHMERE HOUSE website is the exclusive intellectual property of CASHMERE HOUSE. Any reproduction, exploitation, rediffusion, or use of the elements of the website, whether software, visual material, or sound files, in whole or in part, is strictly forbidden.

15. Applicable law and competent jurisdiction

The sales of products by the CASHMERE HOUSE company are regulated by French law. Any litigation regarding the interpretation, execution or breach of contract made between CASHMERE HOUSE and the Buyer, even in the case of multiple defendants, unless subject to dispute among the parties, will be the exclusive competence of the courts of Paris.
